Request for Exception (RFE) Guide
If standard Florida medical marijuana dosage limits are not meeting your medical needs, we can petition the state for a limit increase.
What is a Request for Exception (RFE)?
The Florida Office of Medical Marijuana Use (OMMU) enforces standard daily dose and 35/70-day supply limits on all medical cannabis routes of administration. A Request for Exception (RFE) is an official clinical petition filed by a qualified physician on your behalf to authorize dosages that exceed these default limits.
This process is designed for patients who, due to severe conditions, high tolerance, or unique clinical requirements, need higher amounts of THC or smokable flower to manage their qualifying condition.
14-Day Review
The state OMMU reviews RFE applications within 14 calendar days. If no decision is rendered in this period, the request is automatically approved.
210-Day Validity
Approved RFEs are tied directly to your active certification cycle and must be renewed every 7 months when your physician orders are updated.
Clinical Rationale
Requires clinical history, diagnostic records, and a detailed physician justification explaining why standard state limits are insufficient.
Standard Florida Dosage & Supply Limits
The state enforces default limits on the maximum amount of THC and smokable flower you can purchase in a rolling cycle:
| Route of Administration | Daily Limit | Standard Supply Limit |
|---|---|---|
| Smokable Flower | 2.025 Grams / Day | 2.5 Ounces (per 35-day period) |
| Inhalation (Vapes/Concentrates) | 350 mg THC / Day | 24,500 mg THC (per 70-day period) |
| Edibles | 60 mg THC / Day | 4,200 mg THC (per 70-day period) |
| Oral (Capsules/Tinctures) | 200 mg THC / Day | 14,000 mg THC (per 70-day period) |
| Sublingual | 190 mg THC / Day | 13,300 mg THC (per 70-day period) |
| Topical | 150 mg THC / Day | 10,500 mg THC (per 70-day period) |
| Suppository | 195 mg THC / Day | 13,650 mg THC (per 70-day period) |
Registry Tracking: Non-smokable routes have a combined aggregate limit of 24,500 mg THC per 70-day cycle. Limits operate on a rolling registry cycle.
How the Exception Request Process Works
Requesting an exemption is a clinical process integrated directly into your evaluation with Releaf MD:
- Clinical Consultation: During your consultation with Dr. Kelly Ennix King, discuss your treatment and dosage patterns. If you require higher amounts to manage your symptoms, she will evaluate the medical necessity of an exception.
- Evidence Assembly: Our staff will gather your clinical history, medical records, and diagnostic logs to document why standard limits are insufficient.
- Registry Filing: Dr. Kelly submits the RFE petition electronically through the OMMU Medical Marijuana Use Registry (MMUR).
- Registry Update: Once approved, the state registry instantly adjusts your profile, permitting dispensaries to fill your higher order quantities immediately.
Changes and Physician Transfers
Please note that approved exception requests do not transfer between clinics automatically. If you switch to another certifying physician, your new doctor must evaluate and file a new RFE to re-authorize your higher limit.
Frequently Asked Questions
Is an approved exception permanent?
No. RFEs are valid only for the duration of your active 210-day certification cycle. At each 30-week renewal visit, your certifying doctor must submit a new RFE to keep the exemption active.
What are the limits while the state reviews my RFE?
While the RFE is pending with the Office of Medical Marijuana Use (up to 14 days), your purchasing limits remain capped at the default state quantities.
